1. AGREEMENT TO TERMS

By accessing the Site, you confirm that you have read, understood, and agreed to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

4. SMS/MOBILE MESSAGING TERMS AND CONDITIONS

This section specifically governs our A2P 10DLC compliant messaging program.

Precise Painting and Roofing LLC (hereinafter, “We,” “Us,” “Our”) operates a mobile messaging program (the “Program”) subject to these Mobile Messaging Terms and Conditions.

• User Opt-In: The Program allows Users to receive SMS/MMS mobile messages by affirmatively opting into the Program, such as through online enrollment forms or by texting a keyword to our number. By signing up, you agree to receive recurring automated promotional and personalized marketing text messages (e.g., cart reminders, estimate follow-ups, project updates) from us at the cell phone number provided. Consent is not a condition of any purchase.
• Cost: Message and data rates may apply. Check your mobile plan and contact your wireless provider for details.
• Message Frequency: Message frequency varies. We reserve the right to alter the frequency of messages sent at any time.
• Carrier Liability: Carriers (including T-Mobile, AT&T, and Verizon) are not liable for delayed or undelivered messages.
• Opt-Out: You may opt out of the Program at any time. If you wish to opt out of the Program and stop receiving mobile messages from us, reply STOP, QUIT, CANCEL, OPT-OUT, or UNSUBSCRIBE to any mobile message from us. You understand and agree that alternative methods of opting out, such as using alternative words or requests, will not be accounted for as a reasonable means of opting out.
• Support: For support or assistance, reply HELP to any message or email us at info@precisepaintingtexas.com.

5. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Site, you agree not to:

• Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

• Availability: All services are subject to availability. We reserve the right to discontinue any service at any time for any reason.
• Prices: Prices for all services are subject to change.

8. GOVERNING LAW

These Terms shall be governed by and defined following the laws of the State of Texas. Precise Painting and Roofing LLC and yourself irrevocably consent that the courts of Texas shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

9. DISPUTE RESOLUTION

• Binding Arbitration: Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by binding arbitration.
• Restrictions: The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Site; (2) breach of these Terms of Use; (3) any breach of your representations and warranties set forth in these Terms of Use.

11. LIMITATION OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
